Minors and Alcohol

In California, there is a zero-tolerance policy when it comes to underage drinking and driving. There are a number of different offenses that you can be charged with as a minor drinking and driving.

  • Civil offense: If you have any measurable alcohol in your system, you may be facing a civil charge. If you submit to an alcohol test and you have been drinking and driving you will likely have a one-year suspension or wait for driving privileges. If you do not submit to a test, you will likely have between a one- and three-year suspension.
  • Criminal offense: If you are under the age of 21 and were caught driving under the influence, and your BAC is greater than .05, you are considered to be driving under the influence. The consequences for this charge are fines, loss of license and participation in alcohol programs.
