Common Sentences for White Collar Criminals

Prison terms for white collar criminals consist of fines, jail time, and restitution to the victims.  Someone who is charged with a white collar crime has a lot to lose besides time in jail.  They could have to forfeit their assets, forgo future associations with corporations or government entities, lose their professional reputation, and perhaps incriminate their business associates to achieve a less severe punishment.

Commonly for large corporations, a deferred prosecution agreement will be sought instead of an indictment.  This mode of punishment is the most preferred by corporations.  The federal government makes the corporation pay a fine, reform its ways, and live up those reforms for a time period specified by the Justice Department.

Another type of sentencing that is sought is a non-deferred prosecution agreement.  In this type of agreement, the corporation can pay the fine without a guilty plea, and no criminal charges are filed.

There have been a large number of white collar criminal cases in the news lately.  When the economy is down and business for corporations decrease and employees lose their jobs - there is usually an investigation into the reason why.  If the investigation reveals fraud, embezzlement, bribery, counterfeiting; the company’s and the employees’ reputation, creditability, and future financial relationships will be adversely affected.
