San Jose Corporate Crime Defense

Speaking with Investigators

In our defense strategy, we advise our corporate and business clients not to speak to government investigators before consulting with us.  Investigators from the Security and Exchange Commission, FBI, and Justice Department may ask you questions which can be used as evidence during your trial.  This is very important because what you say, or may not say, can hurt you. We will explain this in more detail at our consultation.

Selecting a Jury
Most likely the people that make up the jury will be educated differently than you, hold different power than you do, and have different financial resources than you do.  We will advise you of the risks in taking the stand.  The jury has to believe that you are guilty beyond a reasonable doubt. Sometimes it's best for you not take the stand.  Again, this is something we will discuss when we meet you and strategize your defense.

The Loopholes
In business and corporate crimes, a company may agree to a deferred prosecution agreement.  A deferred prosecution agreement is when charges are filed against a company but if the company is in good standing and doesn't violate any laws for two years, the charges are dropped.  The company will pay a fine.  Another loophole in business crimes is called a non-prosecution agreement. In this type of agreement, the company pays the fine without criminal charges or a guilty plea.
