What are the punishments for DUI in San Jose, California?

      • Attend 3 month program at a state approved DUI school
      • Community service
      • Installation of an ignition interlock device in your car
      • Attendance at Alcohol Anonymous meetings
      • Court Probation up to 3 years

San Jose DUI Second Offense:

      • At least 96 hours in jail
      • Fine up to $2,800
      • 2 year license suspension
      • Installation of an ignition interlock device in your car
      • Attend 18 month program at a state approved DUI school
      • Court probation up to 5 years

San Jose DUI Third Offense:

      • At least 120 hours in jail
      • Fine up to $2,800
      • 3 year license suspension
      • Installation of an ignition interlock device in your car
      • Attend 18 month program at a state approved DUI school
      • Formal probation up to 5 years


Extra penalties may be imposed for:

      • Driving with a child 14 or under
      • Speeding in excess of 20 mph on streets or 30 mph on highways
      • Refusing a test
      • Having 1 or more prior convictions in the last 10 years
