Penal Code 1000 outlines diversion program options for drug offenders. Depending on your prior drug history, you may be eligible for rehabilitation instead of prison time. Certain rules must apply: you have no prior drug convictions, the drug crime was nonviolent (such as drug possession) and you have not been convicted of a felony within the last five years.
If a drug diversion program is not an option, we will use the Substance Abuse and Crime Prevention Act of 2000, also known as Proposition 36. This allows first and second time nonviolent offenders the opportunity to receive treatment for substance abuse instead of jail time.
